Terminology and DefinitionsFor the purpose this Process Handbook and any other documentation or communication from the ICTI CARE Process the following terms and definitions shall be used consistently: "Audit Company" means a provider of auditing and monitoring services in the field of social compliance. "Accredited Audit Company" means an Audit Company that has been accredited by the ICTI CARE Foundation to carry out audits as a part of the ICTI CARE Process. "Convergence" means the process of converging existing social compliance systems to reduce the number of duplicative audits of factories and avoid overlapping between systems in general. From the point of view of the ICTI CARE Process, this is typically achieved by seeking recognition of the ICTI CARE Process from retailers and other social compliance systems. "Convergence Database" means the publicly available database from the website of the ICTI CARE Process with details about retailers and other social compliance systems that recognize the ICTI CARE Process. "Corrective Action Plan" (CAP) means the plan that is put in place by a factory and/or Accredited Audit Company to correct identified violations to the ICTI Code of Business Practices. "Date Certain" means a date after which a company agrees to only source from factories that hold a valid ICTI CARE Seal of Compliance. "Date Certain Database" means the publicly available database on the website of the ICTI CARE Process with details about all companies that have committed to a Date Certain. "Director of Operations" means the staff member of the ICTI CARE Foundation responsible for the day-to-day operations of the ICTI CARE Process in a particular region. "Donation" means a financial donation made to the ICTI CARE Foundation. "Fundraising" means the process of raising seed funding for the ICTI CARE Process until its Operations become financially sustainable. "Governance Board" means the Governance Board of the ICTI CARE Foundation. Its purpose is to oversee and run the ICTI CARE Foundation. "ICTI" means the International Council of Toy Industries. "ICTI Asia Ltd." means the company [insert complete name and registration number] incorporated in Hong Kong. Its purpose is to serve as the operational arm for the Asian operations of the ICTI CARE Process. "ICTI CARE Code Framework" means the ICTI Code of Business Practices and all related guidance documents, checklists, country specific documentation and other types of official interpretation tools. Including any translation of any of these documents. "ICTI CARE Foundation" means the non-profit association [insert complete name and registration number] incorporated in the State of New York, USA. Its purpose is to own and run the ICTI CARE Process. "ICTI CARE Process" means the international toy industry's ethical manufacturing program, aimed at ensuring safe and humane workplace environments for toy factory workers worldwide. "ICTI Code of Business Practices" means the code of conduct developed by ICTI that established the basic norms of the ICTI CARE Process. "ICTI Excom" means the Executive Committee of the International Council of Toy Industries (ICTI). "Operations" means any day-to-day operation of the ICTI CARE Process, including but not limited to audit operations, Date Certain program, Convergence Process, and management of relationship with external partners and stakeholders. "President/CEO" means the President/CEO of the ICTI CARE Foundation. "Seal of Commitment" means the certificate that is given to brands and companies that have committed to a Date Certain. "Seal of Compliance" means the certificate that is given to factories that have fulfilled the requirements and standards of the ICTI CARE Process. "Secretariat" means the Secretariat of the ICTI CARE Foundation. "Technical Advisory Board (TAB)" means the group of experts that volunteer their expertise and knowledge to the audit operations of the ICTI CARE Process. "Terms and Conditions" means the Terms and Conditions of the ICTI CARE Foundation. Factory Status Terminology and Definitions"Applicant" signifies a factory that has submitted application documents to ICP, but has not settled the application fee. "Registrant" signifies a factory that has paid the application fee, is registered in ICP and has received a registration number, but has not yet had its first audit. "In Progress" signifies a factory that is working through a Continuous Improvement Program (CIP) and has not met its target level of working hours, or a Corrective Action Plan (CAP) and has not yet passed a re-audit. "Probation" is the status of an applicant or a seal holder which is under more frequent monitoring by the ICTI CARE Process (currently 4 times in 12 months) to ensure that the applicant/seal holder complies with ICP’s Codes of Business Practice (COBP) within the specified probation timeframe. Factories are generally put on probation for critical non-compliances and transparency issues found during audits. "Seal of Compliance" is the certificate given to factories that have fulfilled the requirements and standards of the ICTI CARE Process.
"Suspension" is the status of an applicant or a seal holder who fails to comply with the ICP’s Code of Business Practice (COBP) within a specified time frame and who is not permitted to re-apply for the ICP seal for a relatively shorter specified period of time, which will depend however upon their willingness and sincerity to improve. Factories cannot remain in suspension for more than 6 months. "Termination" is the status of a seal holder who has been removed from the ICP program or of a new applicant who is removed from the list of applicants due to critical non-conformity/s against ICP’s Code of Business Practice (COBP) and who will not be eligible to re-apply for the ICP seal for a specified period of time, currently between 6 and 12 months. It may also apply to factories who have defaulted on payment. "Expired" is the status of an applicant or a seal holder that has discontinued its involvement in the ICTI CARE Process by failing to register for annual renewal audits or that has not proceeded with its application. |
